Milwaukee---A status conference has been scheduled for Friday morning in federal court in a case that involves a transgender male student at Tremper High School.
Ash Whitaker's attorneys have filed a pair of court actions, all aimed in part at securing Whitaker's access to bathrooms used by boys and stopping school staff from referring to him as a she. The suits also claim that the Kenosha high school has a plan in place to monitor transgender students by forcing them to wear green-colored wrist bands. The district vehemently denies that's the case.
Federal Judge Pamela Pepper will discuss the original suit and a request for a preliminary injunction with the attorneys in a phone conversation that's scheduled for Friday morning at 9.
On Tuesday, the school district's attorneys filed a response to Whitaker's initial suit, arguing that public schools are not required by law to permit students who identify themselves as transgender to use bathrooms of their choice. In addition, the attorneys said that Whitaker's arguments cannot overcome the privacy rights of male students who might feel uncomfortable by Whitaker's use of boys' bathrooms.
